Depo Terms of Use

These Terms of Use govern your use of Depo, a budgeting app made by Sergey Kaplichnyi (“we,” “us,” or “Depo”).

By downloading or using Depo, you agree to these Terms.

What Depo does

Depo helps you record spending and view a daily amount you may choose to spend. It is a personal budgeting tool, not a bank, lender, broker, investment adviser, tax adviser, accountant, or financial planner.

Depo does not connect to your bank accounts and does not move money.

Your decisions are yours

Depo’s calculations and displays are based on the information you enter and the settings you choose. They may be incomplete, inaccurate, or unsuitable for your situation.

Use your own judgment before making financial decisions. Do not rely on Depo as the sole basis for decisions about spending, borrowing, investing, taxes, insurance, or other financial matters.

Your data

You are responsible for the information you enter into Depo and for keeping your device secure.

Depo is not responsible for lost data caused by device loss, deletion, software issues, operating-system changes, or circumstances outside our reasonable control. Keep an export of your data if that matters to you.

Depo+

Depo may offer optional paid features under “Depo+.” Prices, billing periods, and available plans are shown before purchase.

If you buy an auto-renewable Depo+ subscription:

  • Payment is charged to your Apple Account at confirmation of purchase.
  • Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current billing period.
  • Your Apple Account is charged for renewal within 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription in your Apple Account subscription settings after purchase.
  • Where offered, any unused portion of a free trial ends when you purchase a subscription.
  • We may change subscription prices or available features as permitted by Apple and applicable law. Apple will provide notice where required.

You can restore eligible purchases through the “Restore Purchases” option in Depo.

Purchases are handled by Apple and are subject to Apple’s applicable terms. Except where required by law or Apple’s policies, payments are non-refundable.

Acceptable use

You may use Depo for personal, lawful purposes. You may not:

  • Copy, modify, distribute, sell, lease, or reverse engineer Depo except where law allows it
  • Interfere with the app or its services
  • Use Depo in a way that violates law or another person’s rights
  • Misrepresent your relationship with Depo

Intellectual property

Depo, its design, text, software, and other content are owned by Sergey Kaplichnyi or used with permission. These Terms give you a limited, personal, non-transferable, revocable right to use Depo — not ownership of it.

Availability and changes

We may change, suspend, or end any part of Depo or Depo+ at any time. We will make reasonable efforts to provide notice of material changes when practical.

Disclaimers

Depo is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement.

We do not guarantee that Depo will always be available, error-free, or that its calculations will match your real-world financial position.

Limitation of liability

To the fullest extent permitted by law, Sergey Kaplichnyi and Depo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, savings, data, or goodwill arising from your use of or inability to use Depo.

To the fullest extent permitted by law, our total liability for any claim relating to Depo will not exceed the greater of: (a) the amount you paid us for Depo in the 12 months before the claim, or (b) US$50.

Some places do not allow certain exclusions or limits, so some of the above may not apply to you.

Indemnity

To the fullest extent permitted by law, you will indemnify and hold harmless Sergey Kaplichnyi from claims, losses, liabilities, and expenses arising from your misuse of Depo or violation of these Terms.

Apple terms

These Terms are between you and Sergey Kaplichnyi, not Apple. Apple is not responsible for Depo or its content.

Apple has no obligation to provide maintenance or support for Depo. To the maximum extent permitted by law, Apple has no warranty obligation for Depo, and any claims relating to the app are governed by these Terms and applicable law.

If a third party claims that Depo infringes intellectual-property rights, Sergey Kaplichnyi, not Apple, is responsible for investigating, defending, settling, and discharging that claim.

You represent that you are not located in a country subject to a U.S. government embargo or listed on a U.S. government prohibited or restricted-party list.

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of New York, excluding its conflict-of-law rules, except where the law of your place of residence requires otherwise.

Changes to these Terms

We may update these Terms. The updated Terms take effect when posted, unless a later date is stated. Continuing to use Depo after that date means you accept the updated Terms.
